About Nicholas

Nicholas Tiverios is an Adjunct Associate Professor in Private Law at the University of Western Australia Law School and a barrister at Fourth Floor Chambers. He earned his Doctor of Philosophy in Law from University College London in 2018 as the inaugural Peter Birks Memorial Scholar, supervised by Professors Ben McFarlane and Charles Mitchell QC. He also holds a Master of Laws with Distinction from UCL in 2015, where he ranked first in his cohort of approximately 415 students on the Sir John Salmond Scholarship; a Bachelor of Laws with First Class Honours from the University of Western Australia in 2011; and Bachelor of Science and Bachelor of Social Science degrees from Curtin University in 2007. His career trajectory includes serving as Legal Research Officer in the chambers of the Honourable Chief Justice Robert French AC at the High Court of Australia, practising as a solicitor in Melbourne and as special counsel at a boutique commercial dispute resolution firm in Perth, Teaching Fellow at UCL Faculty of Laws, Lecturer at the University of New South Wales Faculty of Law, and Senior Lecturer at UWA Law School from July 2020 before transitioning to his current adjunct role.

Tiverios specialises in private law, with academic interests in contract law, equity, remedies, unjust enrichment, legal history, and jurisprudence. Notable publications include his monograph Contractual Penalties in Australia and the United Kingdom: History, Theory and Practice (Federation Press, 2019); co-editorship of Justifying Private Rights (Hart Publishing, 2021), featuring his chapter 'Property, Therefore: Justifying Relief Against the Forfeiture of Personal Rights'; 'Preventing the Infinite Regress: Discretion, Bars to Relief and the Structure of Equity' (Cambridge Law Journal, 2023); 'Accuracy, Utility and Gateways: Justifications(?) for Controlling the Use of Surrounding Circumstances in Contractual Interpretation' (Sydney Law Review, 2021); and contributions to Laws of Australia such as 'History and Nature of Equity' (2022) and 'Performance' in Contract: General Principles (3rd ed., 2022). He is the General Editor of the Journal of Contract Law. Honours include the 2022 Blackstone Society Law Teacher of the Year award, Peter Birks Memorial Scholar (2015), and Pump Court Tax Chambers Prize (2015).
